Terms of Service
Effective date: 9 June 2026
These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "subscriber") and Hawa Music SAL("Spoteca", "we", "us", or "our"), a company registered in Lebanon, with offices at Mkales Roundabout, Sin el Fil, Lebanon.
By creating a Spoteca account or using the platform at spoteca.com, you agree to be bound by these Terms. If you do not agree, do not use the platform.
You must be at least 18 years old to create a Spoteca account. By registering, you represent that you are 18 or older and have the authority to bind yourself (or your organisation) to these Terms.
1. The Service
Spoteca is a cloud-based management platform for music schools. It provides tools for managing students, teachers, lessons, schedules, payments, attendance, and communications.
The platform is offered on a Software-as-a-Service (SaaS) basis. You access it via a web browser; no software installation is required.
We reserve the right to update, modify, or discontinue any feature of the platform at any time, with reasonable notice where the change materially affects your use of the service.
2. Account Registration
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- You must notify us immediately at support@spoteca.com if you suspect any unauthorised access to your account.
- Each school workspace is independent. An account registered for one school cannot be used for another.
- You may not share your login credentials with others outside your school workspace.
3. Free Trial
- New accounts begin with a 30-day free trial. No credit card is required to start a trial.
- During the trial, all platform features are fully available.
- The trial starts automatically when you complete registration.
- At the end of the trial, if your school has 10 or fewer active enrollments, your account remains on the Free plan (see Section 4) with no action required. If you have 11 or more active enrollments, you will be prompted to upgrade to continue.
- We reserve the right to modify or discontinue the free trial offer at any time, without affecting trials already in progress.
4. Pricing & Billing
4.1 Pricing tiers

An "active enrollment" means any student enrollment with a status of Activeat any point during the billing month. Paused or inactive enrollments are not counted.
4.2 Invoicing
- Invoices are issued at the end of each calendar month based on your highest active enrollment count during that month.
- Invoices are sent by email to the billing email address on file.
- Payment is due within 15 days of the invoice date.
4.3 Payment methods
We currently accept the following payment methods:
- Cash — at Mkales Roundabout, Sin el Fil, Lebanon.
- Whish — transfer to +961 3 243 847.
- OMT — transfer to +961 3 243 847.
We do not process credit or debit cards online at this time.
4.4 Late payment
- If an invoice is not paid within 15 days, the account status moves to Past Due. Certain features may be restricted.
- If payment is not received within 30 days of the invoice date, the account may be suspended. Data is retained during suspension but access is locked.
- After 90 days of non-payment, we reserve the right to permanently delete the account and all associated data.
4.5 Price changes
We will give at least 30 days' notice by email before any price increase takes effect. Continued use of the platform after the notice period constitutes acceptance of the new pricing.
5. Cancellation & Refunds
- You may cancel your Spoteca subscription at any time by contacting us at support@spoteca.com or via WhatsApp at +961 3 243 847.
- Cancellation takes effect at the end of the current billing month. You retain full access until the end of that month.
- No refunds are issued for fees already paid or owed for the current billing period. There are no pro-rated refunds.
- You may export all of your school's data at any time before cancellation using the Export feature in the Super Admin panel. After the account is deleted, data cannot be recovered.
6. Acceptable Use
You agree not to use Spoteca to:
- Violate any applicable law or regulation.
- Store or transmit content that is unlawful, defamatory, obscene, or harmful.
- Upload viruses, malware, or any code intended to damage the platform or its users.
- Attempt to gain unauthorised access to any part of the platform or another user's account.
- Reverse-engineer, decompile, or copy any part of the platform without our written permission.
- Use automated scripts or bots to scrape or interact with the platform.
- Use the platform on behalf of a competing service.
- Enter false or misleading information about students, teachers, or financial records.
We reserve the right to suspend or terminate any account that we believe, in our sole discretion, is in violation of these rules.
7. Your Data & Our Obligations
- You own your data. All data you enter into Spoteca (student records, teacher profiles, payment histories, lesson notes, etc.) remains yours. We do not claim any ownership over it.
- We will process your data only as described in our Privacy Policy.
- We will take reasonable technical and organisational measures to keep your data secure (see Privacy Policy, Section 5).
- You are responsible for ensuring you have the right to enter personal data about third parties (students, teachers, guardians) into the platform, and for obtaining any necessary consents.
- You may export a full copy of your data at any time using the built-in Export tool.
8. Intellectual Property
The Spoteca platform, including its design, code, brand name, logo, and all features, is the intellectual property of Hawa Music SAL. Nothing in these Terms grants you any rights in the platform beyond the limited licence to use the service as described herein.
You retain all intellectual property rights in the content and data you submit to the platform. You grant us a limited, non-exclusive licence to host and process that content solely to provide the service.
9. Uptime & Service Availability
We aim to keep Spoteca available 24/7 but we do not guarantee uninterrupted or error-free service. Planned maintenance will be communicated in advance where possible.
We are not liable for any loss or damage resulting from service downtime, data loss caused by technical failures outside our control, or interruptions to third-party services (hosting, email, push notifications).
10. Limitation of Liability
To the maximum extent permitted by applicable law, Hawa Music SAL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, data, or goodwill, arising out of or in connection with your use of Spoteca, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the total fees you paid to us in the three months preceding the event giving rise to the claim.
11. Disclaimer of Warranties
The platform is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will meet your specific requirements or that it will be free from errors or interruptions.
12. Termination by Us
We reserve the right to suspend or terminate your account, with or without notice, if:
- You materially breach these Terms and fail to remedy the breach within 7 days of notice.
- You engage in conduct we reasonably believe is harmful, fraudulent, or illegal.
- We are required to do so by law.
In the event of termination by us for cause, no refund will be issued for the current billing period.
13. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Lebanon, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of Spoteca shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be submitted to the competent courts of Lebanon.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 daysbefore they take effect. The "Effective date" at the top of this page will always reflect the most recent version. Continued use of Spoteca after a change takes effect constitutes acceptance of the updated Terms.
15. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spoteca regarding the service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
- No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
